Terms of use

These terms govern the use of the services of Hacoeur inc. ("Hacoeur", "we"): marketing agency services (advertising management, SEO, website creation), the One-Click Report by Hacoeur WordPress plugin, and related applications.

1. Acceptance

By accessing our services, installing our plugin or connecting your advertising accounts (Meta, Google and others) to our application, you accept these terms and our privacy policy.

2. Description of the services

Hacoeur provides:

• Marketing agency services: management of advertising campaigns on Meta (Facebook, Instagram) and Google, SEO, web development, and fractional marketing direction.
• The One-Click Report by Hacoeur plugin, which consolidates reporting data from Meta Ads, Meta Lead Ads, Google Ads, Google Analytics 4, Google Search Console, WooCommerce and HubSpot inside WordPress.

3. Account and client responsibilities

The client is responsible for:

• The accuracy of the information provided on subscription.
• Holding the necessary permissions on the third-party accounts they connect (Facebook Pages, advertising accounts, Google Analytics properties and others).
• The confidentiality of their WordPress credentials and of the access tokens stored in their installation.
• Complying with the terms of use of the third-party platforms (Meta Platform Terms, Google API Services User Data Policy and others).

4. Acceptable use

Our services may not be used to: distribute unlawful content, harass anyone, circumvent the policies of Meta, Google or other platforms, reverse engineer the plugin, or resell the service without written agreement.

5. Intellectual property

The plugin code, the Hacoeur trademark, and the reports and deliverables created by Hacoeur remain the property of Hacoeur inc. The client receives a non-exclusive, non-transferable licence to use them for the duration of the subscription or the engagement.

The client's data (leads, statistics, generated reports) remains the property of the client.

6. Rates and payment

Agency service rates are agreed by contract or by written proposal. Invoices are payable on the terms stated. Late payment may result in suspension of the service.

7. Termination

The client may terminate at any time by uninstalling the plugin, revoking Meta and Google access from the settings of the platforms concerned, and notifying us at info@hacoeur.net. Hacoeur may terminate the service in the event of a breach of these terms.

8. Limitation of liability

The service is provided "as is". Hacoeur does not warrant uninterrupted operation, the continued availability of third-party APIs (Meta, Google), or any specific commercial results. Hacoeur's liability is limited to the amounts paid by the client for the service concerned during the 12 months preceding the incident.

9. Confidentiality and data

The processing of personal information is described in our privacy policy. Deletion instructions are available on the data deletion page.

10. Governing law

These terms are governed by the law of Quebec, Canada. Any dispute will be submitted to the competent courts of the judicial district of Longueuil.

11. Changes

Hacoeur may amend these terms. Substantial changes will be communicated by email or by notice within the service, with reasonable advance warning.
